1 PAYMENT AND REFUND POLICY All payments for video services are refundable for the 3 continuous days from the time of purchase. Cancellations must be provided in writing to info@miamiweddingmovies.com

A 30% non-refundable retainer/deposit of total fee is required upon signing and returning this contract. The retainer/deposit secures and guarantees your wedding date and production team.

A second installment of 70% of total fee must be paid 2 weeks before the event or WEDDING MOVIES will reserve the right no to attend such event and the non-refundable retainer/deposit will be forfeited to WEDDING MOVIES and WEDDING MOVIES will be under no further obligation to The Client.
After the event, the video post-production will start once the total fee is paid or if total fee was paid before it.
All modifications to contracted services are subject to applicable pricing and promotions at the time of the requested change. WEDDING MOVIES reserves the right to charge additional fees if the provision of contracted services requires translation from languages other than English.

2 COVERAGE & OVERTIME Official coverage time begins at the agreed commencement of shooting and time shall run continuously. It is the responsibility of the client to secure access to areas for videography and/or photography, permission of church, synagogue or any other officials to videotape and/ or photograph the ceremony and all permits, licenses and approvals needed for WEDDING MOVIES to perform video/photo services, if applicable, at any location. The deposit is non-refundable if such officials prevent photo and/or video shooting. WEDDING MOVIES will abide by the rules of the church or Synagogue regarding camera(s) placement at the ceremony. Permission of the Officiate is required before the camera(s) are set up.

WEDDING MOVIESTMvideographers/photographers are not responsible for lighting restrictions imposed at any of the venues chosen for the event, whether known or unknown by The Client prior to the wedding day. We will make every professional effort to maximize the quality of image given the environment in any location that The Client has chosen, but WEDDING MOVIES is not liable for circumstances outside of our control.
On the day of the event The Customer may decide that s/he wants additional video and/or photography coverage that was not included in this contract. If the videographer’s / photographeŕs schedule permits, s/ he will do so but please note, the maximum overtime is 2 hours, the Customer will be charged an overtime rate of $250/hour.

This request can be made verbally to the videographer/photographer the day of the event. If the Customer requires and authorizes the videographers / photographers to continue the coverage, unless otherwise specified in this Contract, The Customer will be responsible for providing hotel accommodations for the videographer and/or photographer team if applicable and will also be responsible for any incremental out- of- pocket expenses that Al Agua incurs in accommodating the request.

Prior to or during the event, the Customer may inform WEDDING MOVIES of subjects which they would like filmed and/or photographed, but the final content of the images is at the discretion of the Videographer(s)/Photographer(s).

Travel fee varies upon destination. The Client(s) is/are responsible for paying the travel fee for WEDDING MOVIES team, roundtrip airfare, a rental car (including gas and taxes), meals and hotel

accommodations, preferably at the hotel where the bride is preparing for her wedding (it makes the wedding day so much smoother).

3 BREAKS, WEDDING MOVIES requires a warm meal/dinner at the reception. If there is a buffet, we require to be included in the guest count for the buffet. If it is a sit down dinner, we require to have a plate provided for each videographer/photographer.

4 RELOCATION/ RESCHEDULE/ CANCELLATION, if the event(s) are rescheduled due to a change in the date or the event(s) are cancelled. The Client must notify WEDDING MOVIES immediately in writing to info@miamiweddingmovies.com If the event is changed to a new date within one year of the original event date, and WEDDING MOVIES is available on the new date, WEDDING MOVIES will shoot on the new date and apply the retainer. A new contract must be written for the new date. The prices may be modified by WEDDING MOVIES to our then-current market rate. If, instead, WEDDING MOVIES is not available on the new date or the event is canceled entirely, WEDDING MOVIES will refund The Client́s payment less the non-refundable fee (30% of total fee). If the event is cancelled after WEDDING MOVIES arrives at location on the event, the retainer/ deposit (70% of total fee) will be considered “earned”, but the balance (final 30% of total fee) if already paid will be refunded.

If the event must be relocated, due to unforeseen circumstances, WEDDING MOVIES team will make every effort to accommodate your event. However, there is no guarantee that the same contracted services will be available.

5 PRODUCTION, WEDDING MOVIES reserves the right to assign any videographer(s)/ photographer(s) for this assignment. Creative aspects such as shooting and editing style are at the discretion of WEDDING MOVIESTM. The Client is granted full production and editorial control to the experience and creativity of WEDDING MOVIES. WEDDING MOVIES is the exclusive official videographer and/or photographer retained by The Client to cover the event. Friends and family are permitted to operate cameras on the condition that they do not interfere with or get in the way of the official coverage. In the case another outside video/photography Production Company is present at the event, WEDDING MOVIES has cause to discontinue coverage and no monies will be refunded. In the unlikely event that WEDDING MOVIES experiences equipment failure or difficulties, all efforts will be made to find suitable replacement equipment as soon as possible. No further claims or liability will be accepted.

WEDDING MOVIES does not guarantee that all guests, any particular shot, effect, interview or special request will appear in the video/photos.

6 POST-PRODUCTION If something occurred at the event that The Client does not want to appear on the video/photos, The Client must instruct before post-production begins. A draft of the Highlights and the Full-length Edit and/or edited photos will be forwarded to the Client for their review within approximately 8 to 12 weeks after the event or more depending upon our backlog. This draft may receive one set of revisions only, which is included in the original agreed cost. If The Client does not provide editing feedback within two weeks after delivery, then WEDDING MOVIES will consider the draft delivered to be the final draft of that time. Subsequent revisions thereafter or a major re-edit will incur an additional daily rate of US$ 400.00 per day or part thereof.

Raw material is retained by WEDDING MOVIES for no longer than (3) months following the event date. After this time we will permanently remove all footage and photographs from our systems.

7 PERFORMERS, GUESTS AND SERVICE PROVIDERS RELEASE USAGE The Client agrees to provide release forms if needed or general notice to all guests, performers and service providers that the event will be filmed, recorded and/or photographed. With this notice and by virtue of their attendance, all guests, performers and service providers acknowledge and give permission for the use of their images, voices, and likenesses by WEDDING MOVIES.

If the production must be re-edited due to a performer, guest or service provider refusing permission to show their image or use their audio in whatever form no discounts or liability will be accepted by WEDDING MOVIESTMand revisions thereafter or a major re-edit will incur an additional daily rate of US$ 400.00 per day or part thereof.

8 LIABILITY AND GUARANTEES The liability of WEDDING MOVIES shall be limited only to the purchase price for the video and/or photo services provided. The Client agrees to release and hold harmless WEDDING MOVIES from any and all other claims arising out of this agreement. WEDDING MOVIES may terminate this agreement for convenience by giving you notice of termination at least ninety (90) days prior to your event. Upon such termination, WEDDING MOVIES shall pay to The Client a full refund of any amounts previously paid to WEDDING MOVIES under this contract. In the event of such termination, The Client agrees that WEDDING MOVIES shall be limited to such full refund amount. WEDDING MOVIES shall not be liable for any indirect, incidental, special or consequential damages of any kind, and that the total liability of WEDDING MOVIES shall be limited to such full refund.

WEDDING MOVIES will not be liable or otherwise responsible for any failure or delay in providing its services under this agreement due to any events beyond the reasonable control of WEDDING MOVIES including, but not limited to, acts or elements of nature (including fire, flood, earthquake, storm, hurricane, or other casualty), war, civil commotion, labor disputes, strikes governmental regulation or restriction and weather conditions.

WEDDING MOVIES and any of its third party service providers will not be liable or otherwise responsible for any coverage lost or audio quality or any production problems, beyond WEDDING MOVIES control, e.g. bad weather, accidents, poor acoustics/lighting, interference from guests and access restrictions at event locations.

If videographers/photographers cannot perform this Contract in whole or in part due to causes beyond the control of the parties or due to videographers/photographers illness or injury, then WEDDING MOVIES will return all fees to The Client but shall have no further liability with respect to this Contract. This limitation on liability shall also apply in the event that video materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of our professionals. Client agree that an entire event cannot be replicated, reenacted or repeated for the purpose of a re-shoot and limits WEDDING MOVIES liability to the amount paid under this contract. WEDDING MOVIES reserves the right to remove any of its personnel and/or equipment from a location in all instances if it is deemed unsafe due to any events beyond the reasonable control of WEDDING MOVIES or if they are subject to abusive or aggressive behavior. In this instance the Client will be liable for any costs incurred as a result of this.

WEDDING MOVIES will not allow the safety of the personnel and equipment to be compromised. WEDDING MOVIES reserves the right to immediately remove all personnel and equipment in the event of inclement weather. No refund or reduction in price shall occur but, hopefully, the event would be moved indoors where shooting could be continued.

9 COPYRIGHTS All images produced in conjunction with this contract, including all copyrights in such images is owned by WEDDING MOVIES and fully protected by Federal Copyright Law. The Client is granted by WEDDING MOVIES the right to use the video/photo images for personal use only. The Client may post or share the final video/photos on personal websites, Facebook or other share sites. The Client does not have the right to use the video/photo images for profit or in any commercial, advertising, or third party. The Client assumes full responsibility and liability for any public performance or display of the video/photos. WEDDING MOVIES reserves the right to use the materials delivered to the Client for its own promotional purposes, advertising, display, publication or other purposes. Edited master video/ photos and video/photos raw material remain the exclusive property of WEDDING MOVIES unless waived by amendment to this contract.
